Welcome to cancerfund.com, operated by CXO Advisors & Management, LLC doing business as CANCER FUND and CANCER FUND Impact Investments® (“CANCER FUND,” “we,” “us,” or “our”). These Terms of Service govern your access to and use of our website (the “Site”) and affiliated services. Your use of this Site constitutes your agreement to these Terms and our Privacy Policy.
These Terms may be updated at any time. For material changes, we will provide reasonable advance notice. Continued use of the Site after any changes constitutes your acceptance. If you do not agree with these Terms, you must stop using the Site immediately.
1. Communications Consent
By submitting your email address and/or phone number through this Site—or by otherwise providing it to us—you expressly authorize CANCER FUND Impact Investments®, our affiliates, and partners to:
- Email you about opportunities, updates, and other relevant information
- Call or text you at the number provided for informational or engagement purposes, including follow-ups based on your expressed interests
To opt out of email communications, use the unsubscribe link in any email or contact us at privacy@cancerfund.com.
For text/SMS communications, your submission constitutes your prior express written consent as required under the Telephone Consumer Protection Act (TCPA). Message and data rates may apply. Message frequency may vary. Reply STOP to opt out of text messages at any time.
2. For-Profit Status, Securities, and Charitable Giving
CANCER FUND and CANCER FUND Impact Investments® are for-profit entities operated by CXO Advisors & Management, LLC. The use of terms such as “Give”, “Donate”, “Grant”, “impact,” “fund,” or “community” does not imply nonprofit or tax-exempt status for CANCER FUND itself.
This Site includes information about two distinct participation pathways:
Investment pathway: Cancer Fund I, LLC offers investment opportunities under Rule 506(c) of Regulation D promulgated under the Securities Act of 1933. All investment-related content is provided for informational purposes only and does not constitute an offer to sell or a solicitation of an offer to buy any securities. Investment offers may only be made through authorized offering materials and are available only to verified accredited investors in compliance with applicable securities laws.
Charitable giving pathways: The Site shares information about charitable contributions through donor-advised funds (DAFs), including the CANCER FUND Community Donor Advised Fund (CFC-DAF), which is administered by ImpactAssets, Inc., a registered 501(c)(3) organization (EIN: 26-2048480). Contributions made through the CFC-DAF or other donor-advised funds are charitable gifts to the applicable DAF sponsor, not to CANCER FUND directly. The tax deductibility of your contribution is governed by the policies of your DAF provider and applicable tax laws. CANCER FUND does not provide tax advice; please consult your tax advisor.
3. Disclaimer of Warranties
We strive to provide accurate and timely information, but make no guarantees of accuracy, completeness, or suitability. All content is provided “as is,” without any warranty, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and system integration. Use of this Site is at your own risk.
4. Limitation of Liability
In no event shall CANCER FUND, our affiliates, partners, suppliers, or any party involved in creating or maintaining the Site be liable for any direct, indirect, incidental, consequential, punitive, or other damages related to your use of the Site or its contents—even if we have been advised of the possibility of such damages.
5. Intellectual Property
All content on this Site—including text, images, graphics, logos, audio/video materials, and code—is protected by intellectual property laws. CANCER FUND Impact Investments® is a registered trademark of CXO Advisors & Management, LLC (U.S. Reg. No. 8,070,823). You may not use, copy, or reproduce any content except for personal, non-commercial purposes, and only if you maintain all copyright and trademark notices intact. You may not alter, distribute, publish, create derivative works from, or exploit any content without prior written permission.
6. User Responsibilities
You agree not to use the Site for unlawful purposes. You are solely responsible for the accuracy of any information you submit, and you agree not to misrepresent your identity, accredited investor status, or intentions. You agree not to use automated tools to scrape or collect information from the Site without our prior written consent.
7. Third-Party Services
This Site integrates tools and content from third-party providers including customer relationship management platforms, payment and investment processing services, donor-advised fund administration services, analytics and marketing tools, video conferencing and scheduling services, and other technology providers. We are not responsible for those services, and your use of them is subject to their respective terms and privacy policies. Links to third-party websites do not imply our endorsement.
8. Feedback and Submissions
By submitting ideas, messages, feedback, images, or other content through this Site—including through Quick-Looks, Screening Committee, or company funding application forms—you grant us a worldwide, royalty-free, irrevocable, sublicensable license to use, reproduce, publish, adapt, and distribute that content in any format for purposes related to our business and programs. This license does not extend to personal financial information or accredited investor documentation submitted in connection with investment subscriptions, which are governed by the applicable subscription and offering documents.
You represent and warrant that you own or control all rights to content you submit and that it does not violate any third-party rights.
9. Modification and Termination
We may modify, suspend, or terminate this Site or any part of it at any time, with or without notice. We are not liable to you or any third party for doing so.
10. Indemnification
You agree to indemnify and hold harmless CANCER FUND, our affiliates, directors, officers, employees, partners, and agents from any claims, liabilities, damages, and expenses (including attorney’s fees) arising out of your use of the Site or violation of these Terms.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed under the laws of the State of Arizona without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
